Creditor representation

When a debtor owes you money, you rightly want to receive compensation. Attorney Ronald E. Ostrin is highly familiar with recouping losses from debtors who default on good faith loans. He has represented secured lenders, commercial landlords, title companies and many related creditors in collections litigation and bankruptcy actions.

If you know a debtor has filed for Chapter 7 bankruptcy, an early analysis of your case is essential to a just resolution. Bankruptcy courts prioritize claims based on whether the debt was secured or unsecured — and unsecured debts can be discharged within 60 days of the debtor filing for bankruptcy. However, if any part of the claim is based on fraud or some malicious tort, you may still be able to recover entirely on your loan. Mr. Ostrin can help you analyze the character of your loan under bankruptcy and state laws. He can also represent your interests at the first meeting of creditors.

Mr. Ostrin has had the distinct advantage of having represented creditors against a bankruptcy estate where the debtor died, making it the creditors’ responsibility to have their legal claims addressed when weighed against the interest of the beneficiaries to the estate. He understands the importance of title issues and bankruptcy concerns, and is often able to get a big-picture view of competing interests to negotiate sound legal results.
